California/Nevada Leagues Eye Home Depot Lawsuit

ONTARIO, Calif.—Another credit union lawsuit against Home Depot for the costs of the 2014 data breach may be moving forward. 

Jeff Olson, CUAD EVP of government affairs with the California/Nevada CU Leagues  confirmed that the association is working with New York-based law firm of Kaplan Fox & Kilsheimer LLP, and that the league is looking for credit unions to join this class action suit, on a contingent-fee basis. The Credit Union Association of the Dakotas confirmed that it has been among those contacted regarding joining the suit as a plaintiff.

The law firm is looking to get clients situated before early April, according to a statement on the league's website, adding that currently no credit unions from the Dakotas are yet involved.

“Credit unions continue to experience substantial losses stemming from the plague of merchant data breaches," Diana Dykstra, president of the California/Nevada CU Leagues, told CUToday.info in a statement. "The Leagues, as an industry leader, mobilize our membership for action on all fronts to combat merchant breaches and hold these merchants accountable for their actions."

At least two CUs have already filed suit against Home Depot. In Salamanca, N.Y., Cattaraugus County School Employees FCU filed late last year. The Buffalo-based Southern Chautauqua FCU has also filed suit against the large retailer. At least 21 federal lawsuits have now been filed against Home Depot, with many asking for class action status.

The impact of the Home Depot data security breach on credit unions reached a tab of nearly $60 million, according to CUNA.
