Ex-Envista CU Leader’s Sexual Battery Case Hinges On Intent, Not Accident, Attorney Notes

TOPEKA, Kans.—When the state of Kansas tries Daniel Ramsey on a domestic battery charge, it will have to prove the former Envista CU board chairmen intended for the battery to happen, one legal expert emphasized.

As CUToday.info reported, Ramsey was arrested on Sept. 18 in Shawnee County on a sexual battery charge. The arrest warrant alleges that on March 26 Ramsey, 65, physically touched the victim, born in 1972, with the intent to arouse or satisfy the sexual desires of Ramsey or someone else.

“If you look at the charge and at the complaint, they allege Ramsey unlawfully touched another person, the person didn't consent, and the intent was to arouse or satisfy sexual desires of the person taking the action,” explained Matthew Schneider, partner at Honigman, LLP.  “This is an intent statute. So, this can't be an accidental touching. The state will have to show that the person doing this, Gene Ramsey, actually intended for this to happen.”

As CUToday.info reported, Ramsey, 65, has resigned from his credit union position.
