Fired NCUA Board Members Benched Again As Appeals Court Grants Emergency Stay

WASHINGTON—After returning to work last Thursday, fired NCUA Board Members Tanya Otsuka and Todd Harper are apparently on the sidelines again.

The Trump Administration has been granted an emergency motion to stay the district court’s decision last week that denied the government’s initial request for a motion to stay. The emergency motion to stay was granted by the U.S. Court of Appeals for the District of Columbia Circuit.

As CUToday.info reported, U.S. District Judge Amir Ali ruled last week the Trump Administration’s removal of the two Democratic board members was unlawful. The Trump Administration immediately appealed the ruling to the court of appeals.

In its decision, handed down late Friday, the appeals court stated the ruling on the emergency motion to stay is in no way a reflection on how the appeals court may rule on the appeal, and the emergency motion was granted to “give the court sufficient opportunity to consider the emergency motion for stay pending appeal.”

"The legal process in this matter seems to now consist of a series of hairpin turns, and I think credit unions are getting used to it. That's not say that they like it, but in a way it feels almost like the new normal," stated Washington credit union advocate John McKechnie.

Harper and Otsuka were given until Aug. 4 to file their response.
