WASHINGTON—The U.S. Supreme Court ruled this week that President Donald Trump may dismiss Democratic Federal Trade Commissioner Rebecca Slaughter without cause, while also agreeing to revisit broader restrictions on a president’s power to remove FTC members.
While the justices weigh the issue, a lower-court ruling in favor of Slaughter will remain on hold, the Court said. As a result, Slaughter will not continue in office during the litigation.
America’s Credit Unions said the ruling will likely affect the pending lawsuit filed by ousted NCUA Board members Todd Harper and Tanya Otsuka.
While the D.C. Court of Appeals plans to hear oral arguments in the NCUA lawsuit on Nov. 21, the Slaughter case will address the question of whether a federal court may prevent a person’s removal from public office, ACU noted.
ACU added that the Court will hear oral arguments in the Slaughter case during the December argument session.
“That makes a decision likely by June 2026, which will provide Supreme Court guidance in the NCUA case,” ACU said.
